OBJETO Y \u00c1MBITO DE APLICACI\u00d3N \n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9548cd elementor-widget elementor-widget-text-editor\" data-id=\"f9548cd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Mediante este procedimiento REGENERA tiene como finalidad dar respuesta a las\u00a0 situaciones de denuncia y queja en el \u00e1mbito de esta organizaci\u00f3n, aplic\u00e1ndose a todas las\u00a0 personas que prestan servicios en ella, incluyendo personal en pr\u00e1cticas y colaboradores\u00a0 externos.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">REGENERA, al implantar este procedimiento, asume su compromiso de prevenir, no\u00a0 tolerar, combatir y perseguir cualquier manifestaci\u00f3n de las mencionadas conductas en el\u00a0 seno de su organizaci\u00f3n.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">La empresa sancionar\u00e1 tanto a quien incurra en una conducta ofensiva como a quien la\u00a0 promueva, fomente y\/o tolere. Todo el personal de la empresa tiene la obligaci\u00f3n de\u00a0 respetar los derechos fundamentales de todas las personas que conformamos\u00a0 REGENERA, as\u00ed como de aquellas que presten servicios en ella. En especial, se\u00a0 abstendr\u00e1n de tener comportamientos que resulten contrarios a la integridad, dignidad,\u00a0 intimidad y al principio de igualdad y no discriminaci\u00f3n, promoviendo siempre conductas\u00a0 respetuosas.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-51a4be9 elementor-widget elementor-widget-heading\" data-id=\"51a4be9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">2. PRINCIPIOS \n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-56b447b elementor-widget elementor-widget-text-editor\" data-id=\"56b447b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Este procedimiento est\u00e1 basado en los principios de:\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\">a.\u00a0<\/span><b style=\"font-style: inherit;\">Confidencialidad en todo el proceso, <\/b><span style=\"font-style: inherit;\">El proceso debe garantizar que todas\u00a0 aquellas informaciones que se realicen no deben utilizarse por ninguna de las\u00a0 partes que intervienen en el proceso para temas distintos que el objeto del mismo. Los datos deben considerarse como datos protegidos por la Ley\u00a0 Org\u00e1nica de Protecci\u00f3n de los datos de car\u00e1cter personal, entendiendo, que los\u00a0 mismos deben tener una protecci\u00f3n especial en la medida que afectan a la\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">intimidad de la persona.\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\">b.\u00a0<\/span><b style=\"font-style: inherit;\">Protecci\u00f3n frente a represalias<\/b><b style=\"font-style: inherit;\">, <\/b><span style=\"font-style: inherit;\">contra quien realice una comunicaci\u00f3n de\u00a0 buena fe.\u00a0<\/span><\/p><p><span style=\"font-style: inherit;\">c.\u00a0<\/span><b style=\"font-style: inherit;\">Agilidad y celeridad, <\/b><span style=\"font-style: inherit;\">La respuesta a las situaciones de conflicto han de ser\u00a0 r\u00e1pidas, de tal forma que den respuesta a las expectativas de la persona\u00a0 afectada, permitan tomar las medidas cautelares adecuadas e impidan de\u00a0 forma inmediata que las situaciones generadoras del conflicto se prolonguen\u00a0 en el tiempo transformando situaciones reconducibles a otras que podr\u00e1n causar grave da\u00f1o al trabajador <\/span><\/p><p><span style=\"font-style: inherit;\">d. <\/span><b style=\"font-style: inherit;\">Imparcialidad. <\/b><span style=\"font-weight: 400;\">Nombramiento de personal externo e imparcial que\u00a0 cumplir\u00e1n de manera exhaustiva la imparcialidad respecto a las partes\u00a0 afectadas<\/span><b style=\"font-style: inherit;\">.\u00a0<\/b><\/p><p>e.<b style=\"font-style: inherit;\"> Protecci\u00f3n de las personas implicadas, <\/b><span style=\"font-style: inherit; font-weight: inherit;\">las personas mencionadas en la\u00a0 denuncia tienen derecho a:\u00a0<\/span><\/p><ul><li><span style=\"font-weight: 400;\">Ser informadas en el momento adecuado.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">Conocer los hechos que se les imputan.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">Ser escuchadas y aportar pruebas.\u00a0<\/span><\/li><li><span style=\"font-weight: 400;\">Presunci\u00f3n de inocencia y protecci\u00f3n de su identidad.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-10b5f89 elementor-widget elementor-widget-heading\" data-id=\"10b5f89\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">3. PROCEDIMIENTO \n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7561da4 elementor-widget elementor-widget-text-editor\" data-id=\"7561da4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li><b> Prevenci\u00f3n y sensibilizaci\u00f3n.\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Formaci\u00f3n y difusi\u00f3n del protocolo a todo el personal.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Inclusi\u00f3n de medidas preventivas en la cultura organizativa.\u00a0<\/span><\/p><ol start=\"2\"><li><b> Recepci\u00f3n de la denuncia o queja\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Se habilita correo electr\u00f3nico <\/b><span style=\"font-weight: 400;\">confidencial habilitado para tal fin, A fin\u00a0 de garantizar la confidencialidad de cualquier denuncia, reclamaci\u00f3n o\u00a0 comunicaci\u00f3n. REGENERA habilita la cuenta de correo electr\u00f3nico\u00a0 <\/span><b><i>canaldenuncias@regeneraenergy.es <\/i><\/b><span style=\"font-weight: 400;\">y n\u00famero de tel\u00e9fono <\/span><b>647884957 <\/b><span style=\"font-weight: 400;\">a\u00a0 los que solo tendr\u00e1 acceso la persona encargada de tramitar la denuncia o\u00a0 reclamaci\u00f3n y las personas que integran la comisi\u00f3n instructora, y cuyo\u00a0 objeto es \u00fanica y exclusivamente la presentaci\u00f3n de este tipo de\u00a0\u00a0<\/span><span style=\"font-weight: 400;\">denuncias o reclamaciones.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Posibilidad de que la queja sea verbal o escrita<\/b><span style=\"font-weight: 400;\">. Se podr\u00e1 aceptar\u00a0 igualmente las denuncias o reclamaciones que puedan presentarse de\u00a0 forma secreta, por escrito y en sobre cerrado dirigido a la persona\u00a0 encargada de tramitar la denuncia o reclamaci\u00f3n y \u00e9sta la pondr\u00e1\u00a0<\/span><span style=\"font-style: inherit;\">inmediatamente en conocimiento de la direcci\u00f3n de la empresa y de las\u00a0 dem\u00e1s personas que integran la comisi\u00f3n instructora. Se pone a\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">disposici\u00f3n de las personas trabajadoras de la empresa el modelo que\u00a0 figura en este protocolo para la formalizaci\u00f3n de la denuncia o\u00a0\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">reclamaci\u00f3n.<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Garant\u00eda de no represalia para la persona denunciante. Las personas\u00a0 trabajadoras salvo dolo o mala fe, no ser\u00e1n sancionadas por activar el\u00a0 protocolo.<\/span><\/p><ol start=\"3\"><li><b> Admisi\u00f3n a tr\u00e1mite\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>An\u00e1lisis <\/b><span style=\"font-weight: 400;\">preliminar para verificar si los hechos denunciados <\/span><b>entran\u00a0 dentro del \u00e1mbito del protocolo, <\/b><span style=\"font-weight: 400;\">recibida la denuncia o reclamaci\u00f3n, la comisi\u00f3n instructora entrevistar\u00e1 a la persona afectada, pudiendo tambi\u00e9n\u00a0 entrevistar a la presunta persona denunciada o a ambas partes, solicitar la\u00a0 intervenci\u00f3n de personal experto, etc. Este procedimiento informal o fase preliminar tendr\u00e1 una duraci\u00f3n m\u00e1xima de siete d\u00edas laborables a\u00a0 contar desde la recepci\u00f3n de la denuncia o reclamaci\u00f3n por parte de la\u00a0 comisi\u00f3n instructora.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Comunicaci\u00f3n a las partes sobre la admisi\u00f3n o no del procedimiento.<\/span><\/p><ol start=\"4\"><li><b> Investigaci\u00f3n interna\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Nombramiento de una comisi\u00f3n instructora imparcial (normalmente\u00a0 entre 1 y 3 personas con formaci\u00f3n en igualdad o RR.HH.). La comisi\u00f3n\u00a0 tendr\u00e1 una duraci\u00f3n de cuatro a\u00f1os. Las personas indicadas que forman\u00a0 esta comisi\u00f3n instructora, cumplir\u00e1n de manera exhaustiva la\u00a0<\/span><span style=\"font-style: inherit;\">imparcialidad respecto a las partes afectadas Esta comisi\u00f3n se reunir\u00e1 en\u00a0 el plazo m\u00e1ximo de 3 d\u00edas laborables a la fecha de recepci\u00f3n de una\u00a0 denuncia, reclamaci\u00f3n o conocimiento de un comportamiento inadecuado, de conformidad con el procedimiento establecido en el\u00a0 presente protocolo.<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Recopilaci\u00f3n de pruebas<\/b><span style=\"font-weight: 400;\">: entrevistas, correos, testigos, documentos. La comisi\u00f3n instructora realizar\u00e1 una investigaci\u00f3n, en la que se resolver\u00e1 la concurrencia o no de infracci\u00f3n o conducta denunciada tras o\u00edr a las personas afectadas y testigos que se propongan, celebrar reuniones o requerir cuanta documentaci\u00f3n sea necesaria, sin perjuicio de lo dispuesto en\u00a0 materia de protecci\u00f3n de datos de car\u00e1cter personal y documentaci\u00f3n\u00a0 reservada. Las personas que sean requeridas deber\u00e1n colaborar con la mayor diligencia posible.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Declaraciones tanto del denunciante como de la persona denunciada<\/b><span style=\"font-weight: 400;\">, En\u00a0 el desarrollo del procedimiento se dar\u00e1 primero audiencia al denunciado y\u00a0 despu\u00e9s a la persona denunciada. Ambas partes implicadas podr\u00e1n ser\u00a0 asistidas y acompa\u00f1adas por una persona de su confianza, sea o no representante legal y\/o sindical de las personas trabajadoras, quien deber\u00e1\u00a0 guardar sigilo sobre la informaci\u00f3n a que tenga acceso.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Plazo <\/b><span style=\"font-weight: 400;\">limitado y razonable 30 d\u00edas naturales.<\/span><\/p><ol start=\"5\"><li><b> Informe de conclusiones\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Elaboraci\u00f3n de un <\/span><b>informe con hechos constatados<\/b><span style=\"font-weight: 400;\">, valoraci\u00f3n de pruebas\u00a0 y conclusiones sobre si existe el hecho o no. Finalizada la investigaci\u00f3n, la\u00a0 comisi\u00f3n levantar\u00e1 un acta en la que se recoger\u00e1n los hechos, los\u00a0\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">testimonios, pruebas practicadas y\/o recabadas concluyendo si, en su\u00a0 opini\u00f3n, hay indicios o no.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Recomendaciones <\/b><span style=\"font-weight: 400;\">de medidas a adoptar: disciplinarias, organizativas,\u00a0 preventivas, etc.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Env\u00edo del <\/span><b>informe <\/b><span style=\"font-weight: 400;\">a la direcci\u00f3n o al \u00f3rgano competente.<\/span><\/p><ol start=\"6\"><li><b> Resoluci\u00f3n\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Decisi\u00f3n de la empresa sobre la adopci\u00f3n de <\/span><b>medidas correctoras o sancionadoras<\/b><span style=\"font-weight: 400;\">, conforme al Estatuto de los Trabajadores o al convenio\u00a0 aplicable.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">En funci\u00f3n de esos resultados anteriores, la direcci\u00f3n de REGENERA proceder\u00e1 a:\u00a0<\/span><\/p><ol><li><b> <\/b><span style=\"font-weight: 400;\">Archivar las actuaciones, levantando acta al respecto.\u00a0<\/span><\/li><li><b> <\/b><span style=\"font-weight: 400;\">Adoptar cuantas medidas estime oportunas en funci\u00f3n de\u00a0<\/span>las sugerencias realizadas por la comisi\u00f3n instructora del\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">procedimiento.<\/span><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Comunicaci\u00f3n a las partes implicadas, respetando la confidencialidad. <\/span><\/p><ol start=\"7\"><li><b> Seguimiento\u00a0<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Verificaci\u00f3n de que se han aplicado las medidas y que <\/span><b>no se producen\u00a0 represalias<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><span style=\"font-weight: 400;\">Evaluaci\u00f3n del clima laboral.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u2713 <\/span><b>Revisi\u00f3n <\/b><span style=\"font-weight: 400;\">del protocolo si se detectan carencias durante su aplicaci\u00f3n, adoptando medidas preventivas necesarias para evitar reiteraciones en el comportamiento o conducta, reforzar\u00e1 las acciones formativas y de\u00a0<\/span><span style=\"font-weight: 400;\">sensibilizaci\u00f3n.<\/span><\/p><p><span style=\"font-weight: 400;\">Recepci\u00f3n de denuncias y quejas.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Admisi\u00f3n a tr\u00e1mite m\u00e1x. 7 d\u00edas.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">Fase de
